Please read these Terms and Conditions carefully before using the Nishwik platform. By accessing or using Nishwik, you agree to be bound by these Terms.

1. About Nishwik

Nishwik Global Fintech Private Limited ("Nishwik") is a technology platform that facilitates connections between users and RBI-registered NBFCs and scheduled commercial banks for financial products. Nishwik is not itself a lender, bank, or financial institution. All financial products offered on the platform are provided by licensed third-party lending partners.

All loan products, EMI plans, and credit facilities displayed on Nishwik are offered by our NBFC and bank partners. Interest rates, eligibility criteria, repayment terms, and other conditions are determined by the respective lending partners and may vary. Nishwik does not guarantee approval of any application. Final terms are subject to the lending partner's credit assessment.

When you apply for an EMI product through Nishwik, you enter into a credit agreement with the relevant NBFC partner, not with Nishwik directly. Key terms:

6. Intellectual Property

All content on the Nishwik Platform — including design, text, graphics, software, and trade marks — is owned by or licensed to Nishwik and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

7. Limitation of Liability

Nishwik's liability for any claim arising from use of the Platform is limited to the fees paid by the user to Nishwik in the three months preceding the claim. Nishwik is not liable for decisions made by lending partners, or for any indirect, consequential, or incidental damages.

8. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Mumbai, Maharashtra. The language of arbitration shall be English.

9. Governing Law

These Terms are governed by the laws of India. The courts of Mumbai, Maharashtra shall have exclusive jurisdiction over matters not subject to arbitration.

10. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use constitutes acceptance.
